Design of their stores has taken on a more streamlined feel to gain efficiencies. But that resulted in the stores losing their charm and uniqueness. As a purveyor of fine coffee and tea, Starbucks has struggled as of late to get their merchandise to reflect their brand and their history. â€Å"Some stores don’t have coffee grinders, French presses from Bodum, or even coffee filters. † A more focused approach would be: (a)Participating in social media and (b) Gathering customer suggestions would be easier for a company with no meaningful social media experience to manage. It would also make it easier for Starbucks customers to follow-along. The current MyStarbucksIdea website is already unwieldy — lots of wayward ideas have been suggested and many of the ideas suggested are repeated numerous times in various categories. This website will only get more unwieldy. Points of difference: 1. Starbucks provides its customers with a Starbucks Card through which they can have an easy and fast access to the menu items and discounts. These cards are customizable and can be designed by the customers themselves as per their likings. 2. Starbucks follows an environment friendly drive in which every time a customer brings a reusable travel mug gets a 10 cent discount on any Starbucks beverage, anytime. Starbucks passion for reducing cup waste did not start with the Green Project. Since 1985, they have offered a discount to customers who bring in a reusable travel mug and will continue doing so. This is just one of the ways they are fulfilling their commitment to environmental stewardship while working towards a long-term goal of 100% reusable or recyclable cups by 2015. 3. It also offers its customers with various coffee and tea gifts. Customers can register and participate in a 3 months program in which they are sent special exotic flavors of coffee from around the world. BARISTA As of today, Barista exists in over 22 cities, and operates over 140 outlets nationally. In the last 2 years, Barista has opened over 100 outlets in the country and with a new outlet opening nationally every 14 dates, Barista is currently experiencing phenomenal growth. With outlets opening in Sri Lanka and Dubai, Barista is looking at potential growth opportunities in Asia, making it highly competitive international brand. Product Source: Barista sources its coffee beans from around the world, but a major supplier is TATA Coffee, part of the TATA Group that owns a large stake holding in Barista. These coffee beans are then sent to Venice, Italy where they are roasted into a blend exclusively for Barista. The food and desserts at Barista is exclusively catered to by the Taj, who ensures a high standard of quality with all its products. Barista also sells merchandise through its store, all of which is imported. The merchandise accounts for nearly 1/6th of Barista’s overall sales. Barista has a check on the quality of its products every 14 days. Barista also incorporates TQM at its headquarters in Delhi. Since Delhi is the base for all its distribution, quality control measures are adopted there to avoid any poor quality products being distributed. Pricing: Barista has a ‘Skim Pricing Policy’. They began with a higher price, and skimmed the cream for the market. With the sudden spurt of growth in number of outlets, came the benefits of economies of scale. Because of this, they have been able to gradually lower their prices, and appeal to different segments of their target market. Currently, their prices are the lowest they have ever been, and they can competitively match their prices against Cafe Coffee Day’s prices. The prices are constantly changing though, and the last 1-year has seen 3 changes (mostly reductions) in prices. This gradual price reduction meant that Barista could maintain its profit- maximization policy until it could earn large cost savings because of the benefits of high volume. The main factors that affect their pricing are their cost of goods sold. The costs are quite high because imports a majority of its products and product- sources. ? Process: The order and delivery process at Barista is based on self-service, where a customer goes up to the counter to place his order, and goes back to the counter to pick his delivery once it is prepared. Brand Image: Barista positions itself as a brand for anyone who loves coffee. Their products, services and outlets are more like the traditional European cafes, where people would meet for the love of coffee, and for an intellectual appealing time. They position their outlets as a place â€Å"where the world meets†, and they look to appeal to anyone in the 14- 60 age group that loves good coffee and looks for a nice quiet time. Products: Barista’s product mix constitutes a wide range of products that appeal primarily to traditional coffee lovers. Their products themselves are traditional products with traditional names. Food items like croissant, pastas, and sandwiches are complimentary to their coffee, and project a very classic image of Barista. Their merchandising also consists of primarily coffee related products like coffee beans, coffee machines, etc. Prices: Considering that Barista is trying to target a market whose age range is between 18 and 60 years, a pricing policy appealing to this segment is difficult. Extremely low prices act as a deterrent to some customers who might regard it as an indicator or quality, while very high prices cannot be afforded by most of the youth. But since Barista’s current consumer profile is quite young, their prices are mostly inexpensive, and at par with their competitors. People: The people at Barista are characteristically trained to be Pleasant, Polite and Positive. They ensure you have a quiet, uninterrupted visit and provide an escape from the daily pressures of life. Their uniforms are in sober shades of brown and orange, and contribute to the overall laid-back feeling of the cafe. Physical Evidence: Logo, Colors, Images: Barista, since the beginning has looked to use colors in its cafe interiors, logos and images; to project a â€Å"warm, earth glow, synonymous with coffee†. Barista uses shades of Orange & Brown to good effect to promote its â€Å"laid- back† atmosphere. Discrimination against Females in Sports Gender difference has always been an issue in many shapes and forms and throughout many circumstances in the past, present and still will be in the future. This paper focuses on the issue of discrimination against women in sports. Either being an athlete or a coach, women have always been looked upon as not as talented sports wise as men, even though in reality, they are. This issue is articulated in many ways.The news paper Green Leaf Weekly reports from the past that sports editors and journalists think that women’s sport is not â€Å"newsworthy† (Brown, 1993). Just that quote says a whole lot about the lack of respect people have for women who play sports who work just as hard as men to contend in their sport. Research by Eileen McDonagh and Laura Pappana demonstrates that sex segregation in sports does not simply reflect biology, but it actively constructs and reinforces social ideas of female inferiority (McDonagh & Pappana, 2010).For example, it has been a known fact that women have better physiological endurance compared to men, but yet in the Olympics some of the racing events are actually shorter compared to the men because the women are perceived as not being able to handle the same distance men run. In May of 2004 the sports world was flipped upside down when Title IX was put in place. This title should have been put in place a long time ago, but with all the discriminatory gender issues, it took this long to come to be. Title IX prohibits discrimination against girls and women in federally funded education and athletic programs.The law states that schools who do not follow Title IX, will lose their federal funding. This was a huge step in the beginning of discriminatory actions towards females in sport to be diminished. There are many resources available for exploring this subject area. Finding data and charts is hard to find, but there are many news paper articles on discrimination against wome n in sports. Also a few websites as well to help you get informed on how and why there is discrimination towards women in sports in the first place. There is a website called Women’s Sports Foundation that has a lot of information about women in sports.The good thing about this website is that though it focuses on the negative aspects like discrimination, it also focuses on the positive aspects and what women have achieved in sport and what future goals for women’s sports are. A fact the website states that by 2010, 53 athletic opportunities were offered to every 100 high school boys, and 41 athletic opportunities were offered to every hundred high school girls. Though the number is lower than that of the males, it still is much better than 20 years before this time when it was seldom that 7 athletic opportunities were offered to every 100 high school girl.This statistical research shows that discrimination in sports towards women is improving, slowly, but surely. Wome n are the most affected by this issue because they are being discriminated against in sports. More so than just women, younger women have an even harder time as when you are a young girl there are no girl’s leagues, just mixed leagues with boys. When females play with males, a lot of people say discriminatory things about girls and how they are incapable of playing with males.Likely problems that could come out of this for Canadian society would be that the discrimination problem against women will never be fixed, or it could also get worse. Women need to realize their worth and do something about the issues that are being brought towards them in sports. They have the right to play sports and enjoy them just as much as males do, and they are just as talented as males are. There are many solutions to this problem. A few solutions have already been created in order to better the sports world for women.The Title IX was definitely an important time in history when the document wa s put in place that discrimination against women is strictly prohibited in federally funded sports (Steven, 2004). Women’s sports being in the Olympics also play a very important part in helping this problem. Over the years as more women’s sports were added into the Olympics, it got more media coverage and more attention. With this attention, more young females joined the sports world and the female sports world vastly grew. I feel more women’s sports need to be added into the Olympics, and maybe even create a professional women’s sports league, like the NHL or NBA.Creating a professional women’s sports league would definitely capture enough attention to possibly make the discrimination simmer down. Another option is to possibly create women’s sports centers all over the world for women to come together who play sports and possibly make a change and realize there are a lot of other females all around the world who feel just as they feel. Mak ing people aware of the problems of discrimination in sports could open the eyes of a lot of people to see that it actually is a huge problem. In conclusion, sports are meant to be an activity to demonstrate teamwork, hard work, pain, courage and most of all belief.Belief is hard to achieve when you are being discriminated against, and a lot of people turn to sports to gain confidence. Gender in sports shouldn’t matter, sports teach to you the lessons no matter what gender you are. Many people use sports as a getaway from the crazy world now days and they should feel comfortable. Females need to realize their worth to the sports world, and if more people become aware of the problem and try and solve it, many younger females will be inspired in the future society to take sports to a whole new level, without discrimination against females.The problem will never be completely solved, but with determination anything is possible. He brought Mahayana Buddhism to China. Coming to China, he stayed nine years at the Shao-lin Temple (Ã¥ °â€˜Ã¦Å¾â€"Ã¥ ¯ º), located in He-nan Province (æ ² ³Ã¥ â€"çÅ" ). Bodhi-Dharma is well-known in connection to a story expressed by the phrase â€Å"Wall Contemplation Nine Years (é  ¢Ã¥ £ Ã¤ ¹ Ã¥ ¹ ´)†. From the philosophy and practice represented by this phrase, the Chinese Zen Buddhism originated and developed in ensuing generations. The Bodhi-Dharma is respected as the First Zu (First patriarch) of Chinese Zen Buddhism. It is said that he was born as the third prince of a kingdom of south India. Name of the kingdom is expressed with two Chinese characters é ¦â„¢Ã¨â€¡ ³. Late in his life, he left India. It was the year 520 CE (or 527 CE) when he arrived at Guang-zhou of south China by taking a sea route. It is not welll known which course he took on the way. This article proposes a tentative account that the route he took was the Sea Silk-Road. Chinese historical literature describes what took place at the time when he left India. â€Å"He met the King and told him of his wish to go to China. The King tried to persuade him to stay in his home land, but Bodhi-Dharma was determined to go. There was no longer anything for the King to do but to prepare a large boat with necessary items for a safe voyage. His hope was for the future return of Bodhi-Dharma (preferably with the same boat). On the day of departure, the King accompanied Bodhi-Dharma up to the harbor, together with the families of his relatives and vassals. At this moment, there were none who were not in tears. After a three-year voyage, the ship of Bodhi-Dharma arrived at Guang-zhou of south 1 China. There, the local governor came to greet him. It was September of the year 520. It was the time of Emperor Wu of Liang Dynasty (æ ¢ Ã¦Å" , æ ­ ¦Ã¥ ¸ )。 was informed of this event. He  Knowing it, the emperor invited Bodhi-Dharma to the capital Jian-kang (now Nan-jing). What karmic merit is promised?† Bodhi-Dharma replied: â€Å"No merit (ç„ ¡Ã¥Å Å¸Ã¥ ¾ ³)†. The kingdom where Bodhi-Dharma was born is recorded as †Ã© ¦â„¢Ã¨â€¡ ³Ã¢â‚¬  in Chinese literatures. At the time of Tang dynasty (618 907) established a hundred years later from the time of Bodhi-Dharma, it is likely that é ¦â„¢Ã¨â€¡ ³ is pronounced as â€Å"Kang-zhi†. This is close to â€Å"Kanchi† (-puram), an old capital town in the state Tamil-Nadu of south India (the part ‘puram’ means a town or a state in the sense of earlier times). It was a capital of Pallava Dynasty at the time when Bodhi-Dharma was living. The Pallava Dynasty is recorded as an oceanic state, trading with Mediterranean countries to the west and with China, Siam, Fiji and others to the east. It is conjectured that Bodhi-Dharma departed from Kanchipuram to the nearest port Mamallapuram and emba rked from there. On the other hand, from the time of Former Han Dynasty (å‰ Ã¦ ¼ ¢, established in 206BC) more than two thousands years ago, China also traded by sea with south-east Asia, India, Middle-east and Mediterranean countries by using large oceanic boats. It is said that return journey took four years or so between China and Middle-east. In China at the time of 3rd century, oceanic boats were called â€Å"Konron-chuan†. â€Å"Konron (Ã¥ ´â€˜Ã¥ ´â„¢)† meant the area of south-east Asia in general. A picture shows that an early-time trading boat is equipped with wooden arms on its both sides (supposed, for stability). It is noteworthy that there are remains described as China-Pagoda in a trading harbor-town (Nakapattinam) of south India near Sri-Lanka island. This was built by the order of a Chinese king for the sake of Chinese Buddhists who came to India from China for trade or for pilgrimage (perhaps in the 8th century). Kanchipuram is famous now in India as a town of quality silk cloths. Even Indian Buddhist monks used silk goods. This is written in the travel record [2] by Yi Jing (ç ¾ ©Ã¦ µâ€ž, 635 713). Original silks were likely imported from China, although mulberry trees (for silkworms) were planted in south India too. Some sources record that Yi Jing wrote a letter during his stay in Java (691) and sent it to the authorities of Tang Dynasty (at the time of Wu Zetian æ ­ ¦Ã¥â€°â€¡Ã¥ ¤ ©), in which he asked to construct a China Pagoda in India. This corresponds to the above record in India. Sea Route of Fa-Xian (Buddhist monk, 335 -423) A number of Buddhist monks visited India from China and vice versa. A record of most famous travel is that of Xuan-Zang (629-645), who took the land route both ways to and from India. In an earlier travel by Fa-Xian (399 412), he took a land (mountain) route on his way to India and returned back by a sea route. Why Fa-Xian took the sea route on his return is not written in his travel record. It is conjectured that he wanted to avoid steep and dangerous mountain routes because his age had advanced to over seventy at the time. Beginning his way back to China, he stayed at a town at the mouth of the Ganges river and waited for two years to take a large commercial ship. During his stay, he has transcribed Buddhism texts (and possibly looked for a person or a merchant who would assist him on his return journey). By taking advantage of seasonal (monsoon) wind in the beginning of winter, his ship arrived at the island of Simhala (now Sri-Lanka) after fourteen days. It is well known that there is a seasonal wind from the north-east along the east coast of India in the Bengal Bay. After he had stayed for two years in Sri-Lanka too, he took a large ship (possibly helped by another merchant). The number of passengers on board was more than two hundreds. They embarked for the east. In the beginning there was favorable seasonal wind, but from the third day a storm occurred. After thirteen days, they arrived at an island. It is speculated that it was one of Nicobal islands. Tending to repairs due to flooding of the ship, they resumed their journey. After nine or ten days (or ninety days by another reading) by passing through the Strait of Malacca, they arrived at a harbor in Sumatra or Java islands. Fa-Xian stayed there for five months. His trip route is shown by the thick solid curve in the figure (Reference [3]). Route of Fa-Xian (thick solid line) and a speculated route of Bodhi Dharma (dotted line) Helped by another merchant, he took a large ship bound for China where two hundred passengers were on board. Guessing the size of the ship, it could be one corresponding to two carriage cars of a modern electric train connected  side by side and one underneath them. A relief of a big ship remains in Borobudur’s Buddhist structures (below) on the Java Island, which suggests such a ship as Fa-Xian took. Ship relief in Borobudur. They embarked with food on board of fifty days, but they encountered a storm on the way and drifted on the East China Sea. Eighty days after their departure, they arrived at a place on the south coast of Shan-dong Peninsula of China. This was a voyage that occurred at a time a hundred years before Bodhi Dharma. At his time, it appears that voyages across the Indian Ocean by using the monsoon seasonal wind are well-known. It is likely that such a sea route would have been recommended to Fa-Xian. According to modern data of observation, there is Monsoon wind in the Indian Ocean from Indian side to Malay Peninsula from May to September every year. Sea Route of Bodhi Dharma Bodhi Dharma’s ship departed Mamallapuram, a main port closest to Kanchipuram, and headed for Sri-Lanka. This is just a conjecture. It is likely that they stayed there a couple of months waiting for favorable monsoon wind, preparing for the great journey crossing the Indian Ocean. It might take another couple of months to get to a port in Sumatra or Java island. It may have taken a half or more of a year (depending on circumstances) since he departed his home country Kanchipuram. It is likely that he may have been invited by a royal family at the place he was staying, or that he stayed at a temple for rain retreat in summer time according to the Buddhist custum, or that he spent half a year by preparing his next journey, waiting for a favorable wind, or trading. Once everything was ready, they finally embarked for Guang-Zhou, China. It may have taken two months or so to get to their destination. Two years should have been sufficient time for the whole journey. The â€Å"three years† written in the record may imply that it was the third year since he departed his home country, rather than that it took full three years. Bodhi Dharma according  to old records was born in Kanchipuram of south India., and his final place of rest was at the Bear-Ear Mountain of He-Nan Province of China, where there is a temple Kong-Xing Si to commemorate Bodhi-Dharma. However, in the ancient town Kanchipuram where Bodhi-Dharma is supposed to have grown up, there is nothing to remind us of him. It is considerd that there were many Buddhist structures in Kanchipuram, but most of them were destroyed by the ravages of time and by the opponents of Buddhism. At the present time, it is a sacred town of Hinduism. Historical remains related to Buddhism found in that region are very limited in number, although one can come across a large number of Buddhist remains in the Hindu temples of this antique city. In the course of their operations there have been some questionable behaviors concerning internal and external factors that are affecting the flow of operations and in some cases, this behavior may cause serious issues with the integrity of the software and its security. WIRETIME Inc. is a fairly new company competing against BUGusa Inc. That seeks to gain information on BUGusa Inc. by infiltrating its workforce and recruiting its best and brightest. Throughout this paper I will address some of those case scenarios and do my best to answer the questions set forth by the assignment. 1st Scenario: Has WIRETIME Inc. committed any torts? BUGusa Inc. vs. WIRETIME Inc. In this case scenario we find that WIRETIME Inc. has made an intentional negative public statement against BUGusa Inc, and more specifically against its product reliability. This behavior by WIRETIME Inc. can be seen as a gross move against BUGusa Inc. reputation, thus causing distrust in their products and services from the general public, state and federal agencies home and abroad. The behavior demonstrated by WIRETIME Inc. while not uncommon in the business world, can be seen as a defamation or libel tort, and this can give BUGusa Inc. leverage against WIRETIME Inc. in a lawsuit. BUGusa Inc. may sue for any marketing related costs it will incur to help its image rise to new and higher levels of trust within its current customers and future customers nationally and internationally; it wouldn’t  be a surprise if they also try to collect from possible damages it may have incurred from actual or potential loss of profit stemming from the ad circulated by WIRETIME Inc. and the distrust it may have already or potentially cause in the future against BUGusa Inc. WIRETIME Inc. could make the argument that its intention was not to harm BUGusa Inc. reputation because their statements were opinion based and not objective facts. In order to rebuttal the argument by WIRETIME Inc., and to build new trust, BUGusa Inc. could demonstrate that its products and services work well beyond the one-month capabilities that WIRETIME Inc. suggested on its supposedly opinion ad. By demonstrating that their software and services work beyond the one- month mark, they can surely h old their ground against their competitor and possibly create new business and stronger relationships with its consumers, and, at the same time win the lawsuit against WIRETIME Inc. 2nd Scenario: Has WIRETIME Inc. committed any torts? Janet, head of the RD department at BUGusa Inc. has two more years in her contract with her current company. She has been offered a much lucrative opportunity to work for the competition (WIRETIME Inc.) But there is a provision in her current contract that prohibits her to work for the competition for the following two years of her contract even if she was fired before that time expires. This is called the non – compete clause. Janet disclosed this information (non – compete clause) to the head of human resources at WIRETIME Inc. when he or she offered Janet employment with their company. You would think that this information would deter any further headhunting approach from WIRETIME Inc. because of the consequences Janet’s breach of duty to BUGusa Inc. may cause her if she accepts and the liability WIRETIME Inc. picks up by performing this intervening event against the non – compete clause BUGusa Inc. has on Janet’s contract. After Janet exposed the non – compete clause, the head of human resources at WIRETIME Inc. persisted and offered to increase her pay by 10% and added a $5,000.00 signing bonus to the deal. Janet had a duty to BUGusa Inc. and she committed a breach of contract by accepting the offer from the competing company by evidence of acceptance. There was an offer, acceptance, consideration,  consent, capacity, legal purpose, and writing. While it was illegal to work for the competitor, it was not illegal for her to resign from BUGusa Inc. WIRETIME, clearly intended to have Janet violate her legal agreement and contractual restriction with BUGusa Inc. and committed the tort of interference in a contractual relationship between Janet and BUGusa Inc. 3rd Scenario: WIRETIME Inc. (Steve Walter) Discuss BUGusa Inc. Liability for Walters’s actions. WIRETIME Inc. has made it its main mission to infiltrate its competitor and retrieve high value information from BUGusa Inc. by all means necessary. WIRETIME Inc. sends one of its employees, (STEVE) to apply for a position at BUGusa. Such is their luck that Steve, not only gets hired, but he secures a position within BUGusa Inc. research and development department. BUGusa Inc. failed to realize that Steve was an employee at WIRETIME Inc. thus placing the companies’ sensitive information at risk. While at BUGusa, Steve was picked up by an attentive security guard (Walter) who found out through the grapevine and investigation, that Steve was a spy amongst them working for the competitor. Walter decided to approach Steve and take him in to a soundproof room, and retrieve the truth from Steve through intimidating threats against his physical safety for six hours. Steve, of course fearing for his physical well being, disclosed his purpose in the company what information he has passed along and whom he truly worked for. While Walters’s frustration with Steve is understandable, his handling of the situation is totally unacceptable and carries some penalties with it. Walter created an atmosphere of stress, mentally and physically against an employee, regardless of his true intentions; BUGusa Inc. should of done its homework through background checks against Steve and probably saved itself the headache. In a 2002 study of off-reserve Aboriginals, less than half percent of these children complete the twelfth grade (Adelson, 2005).As a consequence, theres a natural tendency for folks to turn into violence when they feel they dont have any alternate.
